Any expression of an LGBT identity, or of being in any sort of LGBT relationship, is strictly forbidden in the Emirates."

Stirling has also expressed concern over the misconception that Dubai is lenient towards LGBTQ+ individuals, emphasising that the arbitrary enforcement of laws makes the city particularly risky:

"It is risky to live in a country under these circumstances, and the community is blasé about the threat they face, largely due to social media.

They were later deported.

  • 2009: A Canadian couple was detained for 28 days after authorities allegedly targeted them for being gay. While issues related to LGBTQ+ travelers can be less likely in these establishments, it’s essential to remain discreet and respectful of the local culture and regulations. It’s easy to be persuaded that Dubai doesn’t enforce existing laws, but that simply isn’t the case."

Through her advocacy, Radha Stirling continues to shed light on the legal perils faced by the LGBTQ+ community in the UAE and urges caution for those considering travel or residence in the region.

    Internet Censorship and Surveillance

The UAE government heavily censors online content, blocking access to LGBTQ+ websites, forums, and dating platforms.

Translations of UAE legal texts are inconsistent, making it difficult for non-Arabic speakers to fully understand the risks.

LGBTQ+ individuals must also be aware that laws regarding public decency and morality are broad and loosely defined. The Federal Penal Code also contains provisions, such as Article 356, which criminalizes “voluntary debasement” or “indecent assault,” and can be applied to consensual same-sex sexual activity.

    Social Norms and Public Conduct

Beyond the legal statutes, prevailing social and cultural attitudes in Dubai are deeply conservative, emphasizing discretion.

This societal stance means that open expressions of LGBTQ+ identity are not accepted and can lead to social ostracization or legal issues.

    Potential Penalties and Dangers

Individuals found in violation of laws against same-sex relations or public indecency in Dubai face a range of potential penalties. These can include fines, imprisonment, and deportation.

However, visitors to the UAE might not face the same level of scrutiny, but they must exercise caution and remain vigilant to avoid potential legal and personal dangers. This stifling legal and cultural environment affects both locals and tourists alike, with the government actively censoring LGBT-related content. Be sure to consult current information and advice before making any travel plans.

Despite the potential dangers and the homophobic environment in the UAE, if you do decide to visit the country, please take extra care, even if it means concealing your true self.

Although it is not advisable for LGBT individuals to visit this homophobic country, if you do decide to visit, please be discreet and mindful of your surroundings and actions.

Reports suggest that authorities sometimes use entrapment tactics, such as monitoring dating apps or chat rooms to lure and arrest individuals. If you must visit the UAE, take the necessary steps to protect yourself while respecting local laws and customs.

The Future For The Queer Community In United Arab Emirates

It’s important to remain vigilant and informed about the current situation in the United Arab Emirates (UAE).

While the 2021 Federal Crime and Punishment Law removed some provisions related to personal relationships, the legal status of same-sex relationships remains precarious in the UAE. The future of LGBT rights in the UAE, particularly for locals versus tourists, must be considered cautiously.

For local LGBT individuals, the situation can be even more challenging.

The country’s only internet provider operates a proxy server that filters content deemed "immoral." Authorities also monitor online activity, including chat rooms and social media, to identify individuals engaged in discussions about LGBTQ+ issues.

    Final Thoughts

While Dubai and the UAE offer luxury, business opportunities, and tourism attractions, they remain deeply conservative in matters of personal freedom and human rights.

That being said, it’s crucial for tourists, especially those identifying as LGBT, to be conscious of the risks associated with traveling in the UAE.

As an LGBT person, I strongly discourage visiting this homophobic country. For instance, public indecency can result in fines ranging from AED 1,000 to AED 50,000, with repeat offenses leading to imprisonment of at least three months and fines up to AED 100,000.

While the death penalty is theoretically possible under Sharia law for certain same-sex acts, particularly for married individuals, there are no known instances of its imposition for consensual same-sex conduct.

Always remember that there are bad actors in any country, and staying vigilant is your best defense.

Can You Be Gay in Dubai? While the situation for international tourists may not be as severe, it is crucial for all travelers to be aware of and abide by the country’s laws and cultural norms.

For locals, the lack of legal protections and the risk of severe punishment pose significant challenges to their lives, livelihoods, and overall well-being.
